Heinemann Price Beat Promise in Arrivals stores

Important information for you to know

These Heinemann Price Beat Promise terms and conditions are important and you should read them fully. But there are some specific terms we wanted to make you aware of. These are set out below.

Exclusions apply (see clause 4.3 and 4.4)

The Heinemann Price Beat Promise is not available in relation to the sale of all alcohol products or in all circumstances. Exclusions apply, including wine, sparkling and champagne. We will not match promotional prices, prices that are below our cost price or prices offered in Excluded Stores.

Purchasing of alcohol (see clause 4.5)

You must be over 18 to purchase alcohol.

Privacy and security (see clause 5.5)

The collection, use, disclosure and handling of personal information is separately governed by our Privacy Policy (which is available at www.heinemann.com.au/en/global/data-protection-statement), together with other terms such as our privacy collection notices.

Heinemann’s limitation of liability (see clauses 5.7 and 5.8)

To the extent permitted by applicable law and subject always to the Non-Excludable Rights, Heinemann will not be liable to you in any way for any cause in connection with this Heinemann Price Beat Promise offer and our liability to you will be limited as set out in clauses 5.7 and 5.8 of these T&Cs.

This notice is also our Disclosure Notice in accordance with section 47A of the Fair Trading Act 1987 (NSW).

1. Background

1.1 The Heinemann Price Beat Promise is administered by Heinemann Australia Pty Ltd (ACN 159 521 33) (trading as Heinemann Oceania) (“Heinemann”, “we” or “our”).

1.2 Heinemann is here to elevate your travel journey by providing an exceptional shopping experience, but we know that price is important too. That's why in our Arrivals stores we’re providing the Heinemann Price Beat Promise for Eligible Products (the “Heinemann Price Beat Promise”).

1.3 If you find a lower price on an identically stocked product that is an Eligible Product at an Included Store in Australia, we promise to match and beat the price instantly at one of our Participating Retail Stores at the time of purchase. That's our Heinemann Price Beat Promise!

1.4 These terms and conditions (T&Cs) contain instructions on how you (“you” or “your”) can use the Heinemann Price Beat Promise, including when and how you can use it, and what products are eligible. A request made by you for us to match and beat the price of a product in-store is deemed to be your acceptance of these T&Cs.

2. Definitions and interpretation

2.1 For the purpose of these T&Cs:

2.1.1 “Arrivals” means the arrivals concourse in an Australian airport.

2.1.2 “CCA” has the meaning given in clause 5.7

2.1.3 “Excluded Stores” means duty free stores located outside of an airport, stores located in airport’s departures concourse and shops operating exclusively online. 

2.1.4 “Eligible Products” means products from our spirits and liqueur ranges, subject to exclusions set out in clause 4.4

2.1.5 “Heinemann” has the meaning given in clause 1.1

2.1.6 “Heinemann Price Beat Promise” has the meaning given in clause 1.2

2.1.7 "Included Stores” means bottle shops with physical stores in Australia, excluding Excluded Stores,

2.1.8 “Ineligible Products” means any products outside our spirts and liqueur ranges, including but not limited to alcohol such as wine, sparkling and champagne, as well as non-alcoholic products such as fragrances, make-up, skin care, fashion & accessories, technology, toys and food.

2.1.9 “Non-Excludable Rights” has the meaning given in clause 5.7

2.1.10 “Participating Retail Stores” means for the purpose of these T&Cs, physical Heinemann stores located in Arrivals of the following airports:

(a) Sydney International Airport; and

(b) Gold Coast International Airport.

2.1.11 “T&Cs” has the meaning given in clause 1.4

2.1.12 “$” is a reference ot Australian Dollars (AUD). 

3. How it works

3.1 Show the lower price being offered by an Included Store for an identical Eligible Product to a Heinemann team member at a Participating Retail Store, via the Included Store’s website URL displayed on your mobile device or a catalogue.

3.2 Match and save instantly: Once approved by us, we’ll match the Included Store’s price on the identical product and take a further 10% off before your transaction is completed – as long as it is an Eligible Product and these T&Cs are met.

3.3 Duration of offer: Subject to clause 5.1and 5.2, the Heinemann Price Beat Promise is an everyday offer.

4. Eligibility requirements

4.1 The Heinemann Price Beat Promise will only apply to Eligible Products.

4.2 The Heinemann Price Beat Promise is only offered in Participating Retail Stores.

4.3 What is included in our Heinemann Price Beat Promise?

4.3.1 The everyday price of any identical Eligible Product stocked by an Included Store.

4.3.2 The Included Store has the identical Eligible Product in stock at the time you are purchasing the product from us.

4.3.3 Only applies to single order prices advertised by Included Stores.

4.3.4 The Heinemann Price Beat Promise is only available at the time of purchase – past or future transactions will not be considered.

4.4 What is excluded from our Heinemann Price Beat Promise?

4.4.1 Ineligible Products.

4.4.2 Identically stocked products stocked an Excluded Store.

4.4.3 Purchases made in Heinemann stores (including physical stores and our webstore) that are not Participating Retail Stores.

4.4.4 Purchases made through our webstore or in our physical stores in the departure’s concourse that you have selected to collect from a Participating Retail Store.

4.4.5 Promotional prices and any offers which are not available to the general public (including, member-specific pricing).

4.4.6 Discounts offered to any staff or similar discounts.

4.4.7 Cash-back, gift vouchers and bundled offers.

4.4.8 Commercial quantities and pricing.

4.4.9 Liquidations, clearance and end of range stock.

4.4.10 Short-dated or damaged stock.

4.4.11 Prices that are below our cost price.

4.4.12 Completed sales transactions.

4.4.13 Future sales transactions.

4.4.14 No further discounts can be applied in addition to the Heinemann Price Beat Promise (including discounts afforded to members of our Heinemann & Me loyalty program).

4.5 To purchase Eligible Products using our Heinemann Price Beat Promise you must be at least eighteen (18) years of age, and we may require you to provide confirmation that you are above 18 years of age before allowing you to make such purchases, as we cannot, by law, supply certain products (alcohol) to individuals under 18 years of age.

5. General

5.1 Heinemann reserves the right to not provide this Heinemann Price Beat Promise or to limit the quantity of products available for price-matching under this Heinemann Price Beat Promise, taking into account relevant factors such as:

5.1.1 the quantity of stock we have of the product; or

5.1.2 if we have other evidence that, based on prior transactional history, you have abused an offer, promotion or guarantee made available by us.

5.2 While we take reasonable steps to ensure the continued availability of the Heinemann Price Beat Promise offer, if the Heinemann Price Beat Promise is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Heinemann, including but not limited to changes to the cost of our inputs or cost price of Eligible Products, Heinemann reserves the right, to the fullest extent permitted by law, to modify, suspend or terminate operation of the Heinemann Price Beat Promise offer, as appropriate.

5.3 The sale of products through Participating Retails Stores is for your private and personal use only, in normal and reasonable household quantities.

5.4 Other terms and conditions may apply to you such as:

5.4.1 our Returns & Exchanges policy;

5.4.2 the Heinemann & Me loyalty program terms and conditions (as applicable to you); and

5.4.3 the Heinemann Webshop Terms of Use (if you purchase from us online).  

5.5 Heinemann collects, holds, uses and discloses all personal information you provide to us as part of the Heinemann Price Beat Promise in accordance with our Privacy Policy together with our other terms such as our privacy collection notices

5.6 We will not be in breach of these T&Cs or otherwise liable to you or any other person for any matter (including unavailability of the Heinemann Price Beat Promise) that is caused by or arises from any event or circumstances beyond our reasonable control.

5.7 Nothing in these T&Cs limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer rights and guarantees set out in Schedule 2 - Australian Consumer Law of the Competition and Consumer Act 2010 (Cth) (“CCA”), as well as any other implied warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Rights”).

5.8  If the CCA or any other legislation implies a condition, warranty or term into the T&Cs or provides statutory guarantees in connection with these T&Cs, in respect of goods and services supplied (if any), Heinemann’s liability for breach of such condition, warranty, or other term or guarantee is limited to the extent it is able to do so, in the case of supply of goods, to Heinemann doing any one or more of the following:

5.8.1 replacing the goods or supplying equivalent goods;

5.8.2 repairing the goods;

5.8.3 paying the cost of replacing the goods or of acquiring equivalent goods; and/or

5.8.4 paying the cost of having the goods repaired.

5.9 We may, from time to time, amend or update these T&Cs including to comply with applicable laws, comply with a legitimate contractual obligation, without notice to you provided such amendments will not have a materially adverse effect upon you. If we amend or update the T&Cs we will take such steps as are reasonable in the circumstances to bring this to your attention, however your continuing and ongoing requests to us to match and beat the price of our products in-store will indicate your agreement to the amended or updated T&Cs. Accordingly, you should ensure that you regularly review them.

5.10 These T&Cs are governed by the laws of New South Wales and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
