Heinemann Oceania Pty Ltd (ABN 36 159 521 338) (we, our, us, Heinemann Oceania) operates Tax & Duty Free sites, and retail stores, across Sydney and the Gold Coast. We are part of the global Heinemann Group.

The Heinemann x ME loyalty program is administered by the parent company of the Heinemann Group, Gebr. Heinemann SE & Co. KG (Heinemann HQ), and Heinemann Oceania assists in operating this program, and providing you with loyalty program benefits, in-store. Joining the Heinemann x ME loyalty program is entirely voluntary.

About this Privacy Collection Notice

We understand the importance of being open and transparent with you in the way in which we collect, store, use and share your personal information. We take protecting your privacy rights very seriously. We strongly encourage you to read this collection notice before you create your online user account or join the Heinemann x ME loyalty program, so that you understand and are comfortable with how we handle your personal information.

Who does this Privacy Collection Notice apply to?

This Privacy Collection Notice applies if you create an account to shop with us and/or choose to join the Heinemann x ME loyalty program. Any reference to you or your is a reference to an account user or a member of the Heinemann & Me loyalty program (as relevant).

What personal information do we collect and how do we collect it?

Personal information How do we collect this information?
Personal, contact and demographic details When you create an online user account with us or join the Heinemann x ME loyalty program, we will collect your personal information (name, email address and phone number). We will also collect your date of birth, age, gender and place of residence (nationality code).
Information about your purchases and transactions When you make purchases using your online user account, we will also collect:
  • your credit card details;
  • information about purchases you have made which count towards your online account or Heinemann x ME loyalty program membership (as applicable), which we may collect from Heinemann HQ as the administrator of the Heinemann x ME loyalty program. This may include information on what, how and when you make purchases, and the price of such purchases; and
  • if you are a member of the Heinemann x ME loyalty program, information about your use of any loyalty program benefits (such as if you use a voucher towards any of your purchases), which we may collect from Heinemann HQ as the administrator of the Heinemann & Me loyalty program.
Information about your flight When you make purchases using your online user account, we will collect information about your flight, such as:
  • departure date and time;
  • departure and destination airports; and
  • flight number.
Online and digital services information When you use our online services (such as our website), we may collect information from you electronically (through “cookies” and other online technologies), which includes information such as your IP address and details about your device. In some cases this may be personal information and other times we cannot identify you.

Why do we collect, store and use your personal information?

We will collect, store and use your personal information for the following purposes:

  • processing your purchase;
  • facilitating the provision of products to you (including to verify your identity, payment details, and to communicate with you in response to your enquiries about our products);
  • sending you SMS reminders about the products you have purchased which are ready for collection in-store (only if you have purchased our products through Shop and Collect);
  • if you are a member of the Heinemann x ME loyalty program, assisting to administer the Heinemann x ME loyalty program (including to properly account for accrued points and other benefits). If you have opted in to receive marketing communications, this includes sending you communications regarding your points, and delivering any benefits to you (such as a voucher or coupon you have earnt as part of the Heinemann x ME loyalty program);
  • complying with our legal obligations, including under the Liquor Act 2007 (NSW), Public Health (Tobacco) Act 2008 (NSW), Liquor Act 1992 (QLD), Tobacco and Other Smoking Products Act 1998 (QLD), Customs Act 1901 (Cth) and to fulfil our reporting obligations to the Australian Border Force; and
  • conducting data analytics on aggregated information to help us understand trends in consumer behaviour, and to improve our products and website.

Marketing communications

In addition, if you have opted in to receive marketing communications we will collect, store, use and disclose your personal information for the purposes of communicating with you via email, SMS, social media, or by regular post, to promote:

  • the Heinemann x ME loyalty program, including special offers and promotions from both us and our partners (such as price discounts); and
  • our products (including to let you know about products that you may be interested in).

You are always in control of the direct marketing communications which you receive and can opt-out at any time. Generally you can opt-out by following the relevant opt-out or unsubscribe instructions in the relevant communication (such as email or SMS message).

Important points regarding opting-out

Receiving other communications

Importantly, regardless of whether you opt out from receiving any or all direct marketing communications, we will still communicate with you if we are required by law to provide you with information, or in relation to the products we are providing you with (for example, in relation to pick-up information for products you have purchased or to send you an invoice in relation to a transaction.

Heinemann x ME loyalty program

If you are a member of the Heinemann x ME loyalty program and you are not opted-in to receive marketing communications (for example, you choose to opt-out of receiving such marketing communications):

  • we will not send you marketing communications (including communications regarding any coupons or birthday vouchers); and
  • your membership will continue and you can:
    • redeem your Heinemann x ME coupons and birthday vouchers in your account profile through the Heinemann x ME App and/or our website; and
    • check your Heinemann x ME loyalty points in your account profile through the Heinemann x ME App and/or our website.

Who will we share your personal information with?

We may share your personal information with:

  • other members of the Heinemann Group (for example, we share personal information with members of Heinemann Group located in Germany and Singapore as they assist us by providing IT support or administering the Heinemann & Me loyalty program);
  • Sydney Airport Corporation Limited and Gold Coast Airport Pty Ltd, with whom we share the nationality code of our customers in an anonymised and aggregated format for statistical purposes;
  • Australian Border Force, with whom we share your nationality and flight number, to demonstrate that duty free sales have only been made to a person making or returning from an international flight, as required under the Customs Act 1901 (Cth);
  • our service providers (such as our IT service providers, advisors and consultants);
  • our partners and suppliers we do business with, to the extent necessary for any purchases you place online to be fulfilled);
  • third parties for the purpose of facilitating or implementing a transfer or sale of all or part of our assets or business, or if we undergo any kind of corporate restructure; and
  • government agencies, regulatory bodies and law enforcement bodies to comply with our legislative and regulatory obligations.

What happens if you do not want to provide your personal information?

If you do not provide your personal information, we may not be able to create your online user account or enrol you in the Heinemann x ME loyalty program, process your purchase, or properly account for your Heinemann & Me loyalty program member benefits.

If you do not wish to provide your personal information, you may wish to purchase products in-person at our stores instead of purchasing products online. For in-store purchases, we must sight your passport and boarding pass. We sight your date of birth to determine your eligibility for age-restricted purchases, and we collect your nationality and flight details to fulfil our legal reporting obligations, but we do not collect any further personal information that you do not volunteer.
